====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 04-05-2018 Heard learned counsels for the petitioner and the State as well as the informant.

The petitioner, already in custody, seeks bail in connection with Mufassil P.S.Case No. 495 of 2017 registered under Sections 302/34 of the Indian penal Code. Allegation in brief is that petitioner along with four others chased the informant's husband made indiscriminate firing causing his death and occurrence was committed on account of land dispute.

Submission is that some of the witnesses, during investigation, have stated that petitioner was not present there and he has no criminal antecedent and is in custody since 07.02.2018.

Whereas learned counsel for the informant submits that

Patna High Court Cr.Misc. No.26419 of 2018(2) dt.04-05-2018 2/2 there was enmity with the petitioner and he along with four others including Ajit Kumar shot informant's husband and bail of Ajij Kumar has been rejected by a co-ordinate Bench of this Court vide Cr. Misc. No. 6310 of 2018.

Having considered the aforesaid facts and circumstances and gravity of the accusation, petitioner's bail is rejected. (Arun Kumar, J) sujit/- U T
