JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-03-2019 The petitioner seeks bail in anticipation of his arrest in connection with G.O. Case No. 537 of 2018 arising out of Bahadurpur P.S. Case No. 236 of 2018, dated 04.06.2018, instituted for the offences under Sections 30(a), 32(2) and 41 of the Bihar Prohibition & Excise Act, 2016.

Regard being had to the fact that the petitioner was earlier also made an accused in case of similar nature, I am not inclined to grant anticipatory bail to him. The prayer for grant of anticipatory bail of the petitioner is, accordingly, rejected.

No.14786 of 2019(2) dt.13-03-2019 2/2 However, should the petitioner surrender before the Court below within a period of four weeks and seek regular bail, the Court below, after taking into account that the name of the petitioner has transpired on the confession of an arrested accused person and that successively, cases are being saddled upon the petitioner because his brother, in the past, had fought with the local police, shall pass necessary orders in accordance with the law, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
