2. The petitioner seeks bail in a case registered for the offence under Sections 448, 323, 307, 302 and 427/34 of the Indian Penal Code.
3. As per the prosecution case, the informant states that he received information from his brother about one of the grand mothers having been done to death and the other lying in an injured condition. He further stated that loot had been committed in the house.

Learned counsel for the petitioner has submitted that petitioner has falsely been implicated in this case. He next submits that petitioner is not named in the FIR and
Patna High Court CR. MISC. No.17490 of 2024(2) dt.23-04-2024 2/2 there is no recovery from his possession and he is in custody since 30.04.2023. He next submits that similarly situated coaccused has been granted bail by this Court passed in Cr. Misc. No. 1318 of 2024.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.
Considering the facts and circumstances of the case as well as the fact that similarly situated co-accused has been granted bail. Accordingly, let the petitioner, above named, be directed to be released on bail in connection with Buniyadganj P.S. Case No.239 of 2022 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VIII, Gaya.
