2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 356 and 379 of the Indian Penal Code .

3 . As per the prosecution case , informant namely Kumari Gayatri Singh alleged that while she along with 2 other ladies were on morning walk , in the meantime , two unknown persons came on motorcycle and snatched gold chain from her neck and fled away .

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R., and his name transpired during course of investigation on confessional statement of co-

Patna High Court CR. MISC. No.16616 of 2025(2) dt.16-04-2025 2/2 accused Md. Abdul Motallib and Dhiraj Kumar who disclosed that stolen gold chain were purchased by this petitioner. He next submits that petitioner has not purchased any stolen gold chain . Petitioner has his own jewellery shop which is running since time of his grandfather. Only because some gold pieces have been recovered from shop of petitioner, a suspicion has been raised against him and after institution of the present case he has been remanded in 6 other cases.

Learned counsel for the State opposed the bail petition of the petitioner and submitted that it is a case of day light robbery in which gold chain of informant was snatched and during course of investigation , name of the petitioner transpired on the basis of confessional statement of apprehended persons and whereupon a raid was conducted and on search 6 gold pieces have been recovered from jewellery shop of this petitioner. Petitioner has got 6 criminal antecedents.

6. Considering the aforesaid facts, criminal antecedent of petitioner and other circumstances of the case , prayer for pre - arrest bail is rejected.
