The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Daraunda P.S. Case no. 160 of 2021 instituted for the offence punishable under Sections 341, 323, 324, 307, 504, 34 of the Indian Penal Code.

It is a case of assaulting and stabbing by means of knife upon the chest of informant namely, Baharan Sah. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. It is further submitted that no injury has been mentioned in medical report of the informant. Petitioner has falsely been implicated in this case.

Patna High Court CR. MISC. No.15397 of 2022(3) dt.10-10-2022 2/2 Learned APP appearing for the State has opposed the prayer of bail and submitted that it is apparent that informant sustained sharp cut injury on chest and the medical report in consistence with the fact of the prosecution case that the allegation against the petitioner stabbing by knife upon chest of the informant.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this is not a fit case to grant anticipatory bail to the petitioner and, as such, his application for bail is rejected.
