ANJANA MISHRA ORAL ORDER 15-05-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner has been in custody since 04.10.2017 in connection with Pirpainty P.S. Case No. 14/17 registered for the offences punishable under Section 396 of the Indian Penal Code.

Learned counsel for the petitioner submits that the case has been registered against unknown persons, but subsequently, in the confessional statement made before the police by one Nakul Pahariya, the name of the present petitioner has transpired and as such, he has himself surrendered in the Court. It is further submitted that the petitioner has no criminal antecedent and there is no recovery from his possession nor has he

Patna High Court Cr.Misc. No.27404 of 2018 (2) dt.15-05-2018 2/2 been placed on T.I. Parade till date. It is next submitted that similarly situated co-accused has been extended the privilege of bail in Cr. Misc. No. 53810 of 2017 vide order dated 08.12.2017.

Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Addl. Sessions Judge, Bhagalpur, in connection with Pirpainty P.S. Case No. 14/17.
