The petitioner seeks bail in connection with G.O. Case No. 51 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Seventy-two liters of Nepali liquor is said to have been recovered from the possession of Sudesh Kumar Singh and Raju Kumar Paswan and the petitioner is said to be purchaser of the said liquor and arrived at the place of occurrence to take the delivery.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious possession of the petitioner. He has no concern with
Patna High Court Cr.Misc. No.26583 of 2018(3) dt.03-05-2018 2/2 the seized liquor. He has been falsely implicated in the case at the instance of his enemies. The petitioner has no concern with the trade of the liquor. Though one more case under Excise Act has been lodged against the petitioner, but, he is on bail in the aforesaid case. He has been languishing in custody since 14.03.2018. Said Sudesh Kumar Singh from whose possession the said liquor was seized has been enlarged on bail by a coordinate Bench of this Court vide order, dated 02.05.2018, passed in Cr. Misc. No. 26633 of 2018.
Considering the facts, aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with G.O. Case No. 51 of 2018 to the satisfaction of the Additional Sessions Judge IIcum-Special Judge, Excise Act, Madhubani. (Prakash Chandra Jaiswal, J) Shamshad/- U T
