Heard the parties.

Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273 of the IPC and Section 30(a),38,41 of the Bihar Prohibition and Excise (Amendment) Act.

Allegation is of recovery of liquor. Petitioner has got no criminal antecedent. Petitioner is in custody since 12.01.2021.

Considering the fact that this is the first allegation against the petitioner under Bihar Prohibition and Excise Act, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties

No.27538 of 2021(2) dt.04-10-2021 2/2 of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Aurai P.S.Case No.51 of 2018 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
