The petitioner has filed the instant application for grant of regular bail in connection with Patliputra P.S. Case No. 378 of 2021 registered under sections 302, 34 of the Indian Penal Code.

It is a case of assaulting to the informant's brother due to which he succumbed to injury during the course of treatment. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this present case. A statement has been made in para 3 of the petition that the petitioner has got no criminal antecedent. The petitioner has no concern with the deceased brother of informant and no specific overt-act

Patna High Court CR. MISC. No.15193 of 2022(4) dt.02-01-2023 2/2 allegation attributed against the petitioner. General and omnibus allegation of assaulting leveled against the petitioner. It is further submitted that the petitioner is languishing in custody since 30.10.2021.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Patliputra P.S. Case No. 378 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge XXV, Patna.
