BADAR ORAL ORDER 27-01-2022 The applicant/accused in Crime No. 147 of 2020 registered with Rafiganj Police Station, giving rise to Sessions Trial No.125 of 2020, for the offences punishable under Sections 304B and 201 read with Section 34 of the Indian Penal Code, by this application is seeking his release on bail during pendency of the trial.
Having heard the learned counsel appearing for the applicant/accused in this case of offences punishable under Sections 304B and 201 read with Section 34 of the Indian Penal Code, it is noticed that in all seven witnesses are already examined by the learned trial court. Evidence of the material witnesses, such as the first informant is already recorded by the learned trial Court.
In this view of the matter, this is not a fit case to
Patna High Court CR. MISC. No.25433 of 2021(6) dt.27-01-2022 2/2 entertain the bail application at the fag end of the trial. Therefore, the application is rejected with a direction to the learned trial Court to dispose of the trial as early as possible and in nay case within a period of two months from today. The parties should cooperate the trial Court in expeditious disposal of the case and the prosecution should keep all its witnesses present before the learned trial Court on the date given for recording the evidence. In case the trial is not concluded within a period of two months from today the applicant is granted liberty to approach this Court afresh. The applicant to remove all office objections forthwith and the Registry to issue the certified copy of this order only after removal of office objections by the applicant/accused.
