The petitioner seeks bail in a case registered under Sections 420, 467, 468, 471, 196, 197, 198, 199, 201, 120(B) of the Indian Penal Code.
Allegation is that the accused persons illegally appointed teachers on the basis of fake documents. It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.12.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is the Mukhiya of the
Patna High Court CR. MISC. No.15645 of 2020(2) dt.06-03-2020 2/2 panchayat. The allegation is that the candidates for the post of teachers were selected but did not have the requisite qualifications and they had produced fake certificates. The petitioner had no knowledge that the certificate in question was fake one. The petitioner had no intention of making such appointment of the teachers.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate XIII, Gaya in connection with Atri P.S. case No.360 of 2018.
