JUSTICE RAVI RANJAN ORAL ORDER 23-05-2016 Heard learned counsel for the petitioner and the State. Petitioners apprehend his arrest in a case registered for the offences punishable under sections 272, 273 and 290 of the Indian Penal Code and section 47(A) of the Excise Act. It is urged on behalf of the petitioner that the alleged "Gumti" from where foreign liquor has been recovered belongs to one Bhuali Ram. It is contended that the petitioner is an agent of LIC and he is handicapped also. In support of that the petitioner has appended Annexure 2 which is a disability certificate showing 60% disability in one of his legs and Annexure 3 is the Identity Card issued by the LIC. It is, thus, contended that in such a situation, while he has 60% disability in one of the legs, then the allegation that he ran away seeing the

Having regard to the facts and circumstances of the case, let the abovenamed petitioner, namely, Nagmani Gupta, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Siwan(Town) Police Station Case No. 560/15 on furnishing bail bonds of Rs.10,000/- ( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
