This application is for grant of regular bail in connection with Nathnagar P.S.Case no.154 of 2017 for the offences punishable under Sections 376/34 of the Indian Penal Code.
Allegation against the petitioner is of committing rape upon the daughter of the informant along with one coaccused person. Submission of the learned counsel for the petitioner is that there is delay of four day in lodging the FIR. Further whatever allegation is there that is against one Ashok Mandal and the petitioner has been falsely implicated in this case. It has also been submitted that medical report does not support the
Patna High Court Cr.Misc. No.42552 of 2017 (3) dt.06-11-2017 2/2 prosecution case.
Heard learned A.P.P. also, who has opposed the prayer for bail.
Having heard both sides and in view of allegation and statement of the victim girl recorded under Section 164 Cr.P.C., I am not inclined to grant bail to the petitioner, hence, the prayer for bail of the petitioner is rejected, however, the learned trial court is directed to expedite the trial of the case.
With the aforesaid observation, this application is dismissed.
