The petitioner has preferred this application for grant of regular bail in a case registered under sections 302,34 of the Indian Penal Code.
The petitioner and other co-accused person in connivance with one-another are said to have committed the murder of the informant's brother. The co-accused, Faiyaz Alam took the informant's brother on motorcycle by calling him from his house and next day dead body of the informant's brother was found in Sadar Hospital, Sasaram.
Patna High Court CR. MISC. No.15776 of 2022(2) dt.14-07-2022 2/3 Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The Petitioner has clean antecedent as stated at para 3 of the bail petition. The petitioner is in custody since 25.12.2021. The co-accused Faiyaz Alam, in his confessional statement has stated the Modus-Operandi as to how the occurrence took place with the association of the petitioner Sangeeta Devi @ Gurmeet Kaur. Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. or concern Court Sasaram at Rohtas, in connection with Sasaram Mufassil P.S. Case No. 44 of 2018. The application stands allowed.
