ANJANA MISHRA ORAL ORDER 25-06-2015 Heard learned counsel for the petitioners and the learned counsel for the State. Learned counsel for the informant is also present.
The petitioners are apprehending their arrest in connection with Marhowrah P.S. Case No.104 of 2014 for allegedly having committed the offences under Section 147, 447, 323, 504, 506, 379, 435, 387 and 188 of the Indian Penal Code.
Learned counsel for the petitioners submits that there is dispute between the parties with regard to sale and purchase
Patna High Court Cr.Misc. No.20102 of 2015 (2) dt.25-06-2015 2/2 of the land. Learned counsel further submits that the petitioners have no criminal antecedents.
Learned counsel for the informant submits that though there was a proceeding pending under Section 144 Cr.P.C., accused persons forcibly came upon the land and have been litigating for taking possession of the same. Considering the nature of disputes and also the fact that the petitioners have no criminal antecedents, let all the seven petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Marhowrah P.S. Case No.104 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
