The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420 and 409 of the IPC.

The prosecution case, as per the written report of Dinesh Kumar Pankaj, the Block Education Officer, Danapur dated 09.01.2019, submitted to the Station House Officer, Danapur Police Station, is to the effect that the District Programme Officer, Patna directed the petitioner to provide the educational and training certificates of all Nagar Parishad Teachers, but he did not submit the same.

It is submitted by learned counsel for the petitioner that the petitioner was transferred from the alleged place of posting on

Patna High Court CR. MISC. No.14622 of 2019(2) dt.11-03-2019 2/2 18.08.2018 and subsequently, the FIR has been registered on 09.01.2019.

Learned APP submits that the petitioner did not submit the folders of all the Nagar Parishad Teachers.

Considering the accusation, which does not suggest negligence on the part of the petitioner and the fact that now the petitioner is not the custodian of the alleged documents coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned ACJM, Danapur in connection with Danapur P.S. Case No. 35 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
