JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-08-2017 The petitioner seeks regular bail in connection with Jhajha P.S. Case No. 105 of 2016, registered for offences punishable under Section 364A of Indian Penal Code. Allegation against the petitioner is of kidnapping the father of the informant and demanding ransom from the informant. It has been submitted on behalf of the petitioner that he has not been named in the F.I.R, his name surfaced on the basis of confessional statement of co-accused and his own confessional statement, which has no evidentiary value in the eye of law and except that there is nothing against the petitioner so as to show his involvement in the present case. Further he has been in judicial custody for more than three months.
Learned counsel for the State opposed the prayer for bail.
Patna High Court Cr.Misc. No.33780 of 2017 (3) dt.02-08-2017 Having heard both sides, considering the fact and circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the trial and try to conclude it within a period of nine months. At the same time, S.P. Jamui, is also directed to ensure the production of witnesses in the court on the date fixed so that the trial can be concluded within the aforesaid period. (Vinod Kumar Sinha, J) sunil/- U
