JUSTICE RAVI RANJAN ORAL ORDER 09-05-2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 468, 471, 419, 420/34 of the Indian Penal Code.

It is contended that the petitioner nos. 1 and 2 are full brothers and the petitioner no.3 is their nephew. They had purchased the land after payment of the consideration amount. It appears that there is dispute regarding shares etc. between the informant and the vendor of the petitioners, who belong to the same family. It is further contended that this is a case of civil nature. It is also urged that none of the competent court of civil

Patna High Court Cr.Misc. No.18531 of 2016 (2) dt.09-05-2016 2/2 jurisdiction has declared the sale deed concerned as null and void as yet.

Having regard to the facts and circumstances of the case, let the petitioners, namely, Subodh Kumar Singh, Vinod Singh @ Kumar Vinod and Murari Kumar Singh @ Murari Kumar be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Begusarai Town (Lohiya Nagar) P.S. Case No.649/2015, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
