2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Jogbani P.S. Case No. 178/2023 registered for the offence punishable under Sections 414 of the Indian Penal Code; Sections 21/22 of the NDPS Act and Sections 25(1-b)a, 26 Arms Act.

3. Earlier the bail application of the petitioner has been rejected vide order dated 27.02.2024 passed in Cr. Misc. No. 75061 of 2023. '

4. The recovery is of 270 gm. of smack and 178 bottles of cough syrup containing codeine. The petitioner is in jail since 11.07.2023.

5. Learned counsel for the petitioner submits that out

6. Considering the period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District & Sessions Judge-IV, Araria/concerned Court in connection with Jogbani P.S. Case No. 178 of 2023, subject to the conditions that the petitioner will co-operate in the trial and both the bailors should be the close relative of the petitioner.

8. The petitioner will also mark attendance in Jogbani Police Station, District Araria on every Sunday of the month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
