KUMAR ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner, who is in custody, seeks bail in connection with Banmankhi P.S. Case No. 178 of 2017 registered for the offence punishable under Sections 341, 323, 324, 307, 379, 504, 325, 447, 34 of the Indian Penal Code.
The allegation against the petitioner is that he gave single iron rod blow on the right hand of Jogendra Sah. The petitioner is serving in the department of Posts, a Central Government Organization.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is a general and omnibus allegation of assault against the
Patna High Court Cr.Misc. No.44801 of 2017 (2) dt.20-09-2017 petitioner and has no criminal antecedent and he is in custody since 30.07.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Banmankhi P.S. Case No. 178 of 2017.
