JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-12-2022 Though, the present writ petition has been filed for quashing the order dated 20.08.2021, passed by the Block Development Offcer, Tekari, Gaya, directing the petitioner to remove the poultry farm in question, however, it is submitted by the learned counsel for the petitioner that the said order has been passed under the garb of an order dated 30.08.2018, passed by a Co-ordinate Bench of this Court, in C.W.J.C. No. 6085 of 2018, whereby and whereunder the District Magistrate, Gaya was directed merely to dispose off the representation of the petitioner of that case, however, there was no direction not to comply with the principles of natural justice or not to hear the

Patna High Court CWJC No.4414 of 2022(2) dt.19-12-2022 2/2 petitioner before passing any adverse orders against the petitioner.

The learned counsel appearing for the respondentState submits that the Block Development Officer, Tekari, Gaya shall issue necessary show-cause notice to the petitioner, within a period of four weeks from today, granting the petitioner due opportunity to reply to the same and shall pass a reasoned and a speaking order, in accordance with law, forthwith and till then status quo existing as on today qua the poultry farm of the petitioner in question shall be maintained. It is directed accordingly.

The writ petition stands disposed off on the aforesaid terms.
