Petitioner, already in custody, seeks bail in connection with Manjhagarh PS Case No.272 of 2017 (Trial No.1989 of 2017), registered under Section 379 of the Indian Penal Code. Later on Sections 328, 396, 412, 413 and 120(B) of the Indian Penal Code were added.

Allegation in brief is that the truck of the informant loaded with mustard oil was found missing and later on dead bodies of the truck driver and cleaner were found thrown somewhere and the truck was found in abandoned condition and it was found that the truck was looted and both driver and the cleaner were murdered.

Patna High Court Cr.Misc. No.25554 of 2018(2) dt.27-04-2018 2/2 Learned counsel for the petitioner submits that the FIR is against unknown and the only material transpired against this petitioner is disclosure of his name by accused Vira Yadav and he also disclosed the name of one Dipak Singh and others. It is further submitted that the petitioner's case is on similar footing to Dipak Singh whose name was also disclosed by Vira Yadav, Dipak Singh has been admitted to bail by a co-ordinate Bench of this Court vide Cr. Misc. No.17830 of 2018 on 10.04.2018, moreover this petitioner has no criminal antecedent.

As the bail of the petitioner is sought on the ground of parity as Dipak Singh, similarly situated, has been granted bail by a co-ordinate Bench of this Court, so petitioner Roushan Singh @ Raushan Singh @ Raushan Kumar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Manjhagarh PS Case No.272 of 2017 (Trial No.1989 of 2017).
