JUSTICE SANJAY PRIYA ORAL ORDER 08-08-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in Bairgania P.S. Case No. 149 of 2017 instituted for the offence under Sections-272, 273 of the Indian Penal Code and Sections-30(A)/41 of Bihar Prohibition & Excise Act, 2016.
It is alleged in the written report that from the joint possession of petitioner Nos. 2 & 3 27 litres Nepali Saufi was recovered. It is further alleged that 9 litres Nepali Saufi has been recovered from possession of petitioner No. 1. In para-3 of the petition, it is mentioned that the petitioners have no criminal antecedent. The petitioners are said to be in custody since 13-06-

Keeping in view the clean antecedent of the petitioners and the period spent in custody, prayer for bail is allowed. The petitioners named above are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bairgania P.S. Case No. 149 of 2017 to the satisfaction of IInd Additional Sessions Judge-cum-Special Judge, Excise Act, Sitamarhi subject to condition that both the bailors should be close relative of the petitioners.
