ANJANA MISHRA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Tikari PS case no. 44/2016 for allegedly having committed the offence under Sections 147, 148, 149, 341, 323, 325, 447, 504, 506 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioner submits that the present case is filed as the petitioner had earlier filed a first information report regarding attack of extremists on the tower located at village Lohanipur where he was posted as a guard. It is submitted that the allegation against the present petitioner by the informant is only in retaliation of the earlier F.I.R. Learned

Patna High Court Cr.Misc. No.16110 of 2016 (3) dt.03-05-2016 2/2 counsel further submits that the injuries alleged to have been inflicted on the side of the informant have been found to be simple in nature.

Considering the entire facts and circumstances and also the injury report let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Gaya in connection with Tikari PS case no. 44/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
