2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 467, 468, 471, 474 and 420/34 of the Indian Penal Code.
3. As per allegation in the FIR, it is a case of committing forgery and cheated the government land by the petitioners and other accused persons.
4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. Petitioners have got clean antecedent.
5. Learned APP for the State opposes the prayer for bail of the petitioners.
6. On perusal of the first information report and impugned
Patna High Court CR. MISC. No.20056 of 2024(4) dt.15-07-2024 2/2 order dated 07.02.2024, it appears that the land situated in AnchalTeghra, Thana No.329, Khata No.1981, Khesra No.8745, MauzaGaura, area 3.247 decimal belonging to the government land and petitioners sold out to one Bhagvanti Devi. A translated copy of the deed no.1812 of 1957 is attached with the petition and the said disputed land bearing khata no.1981 Khesara no.8745 purchased by grand-father of the petitioners, namely, Nemo Das @ Newa Lal Das in the year 1957 and the said land is found to be bonafide land and there is land dispute between the parties, so considering all aspects of the case, I am inclined to grant anticipatory bail to the petitioners.
7. Let the petitioners above named be released on anticipatory bail in the event of their arrest or surrender before the court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Teghra P.S. Case No. 350 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Ramesh Chand Malviya, J) Brajesh Kumar/- U T
