JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 13.7.2017 in Cr.Misc.No. 31079 of 2017 on merit.

Submission of learned counsel for the petitioner is that there was direction of this Court to learned trial court to expedite the trial but till date charge has not been framed in this case and petitioner is in custody since 9.1.2017, having no criminal antecedent.

Having heard both sides and in the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.25419 of 2018 (2) dt.02-05-2018 2/2 satisfaction of Sri Raushan Kumar, Judicial Magistrate, 1st Class, Banka, in connection with Trial No. 831 of 2017, arising out of Chandan (Anandpur) P.S.Case No.03 of 2017, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and petitioner will co-operate in trial and appear in the court below as and when required, failing which his bail bond shall stand cancelled.
