JUSTICE SUDHIR SINGH ORAL ORDER 25-06-2015 The petitioner is apprehending his arrest in connection with complaint case No. 982C /2014 for the offence under section 498(A), 494 of the Indian Penal Code.

Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that the complainant was married with the petitioner in 2009 and when she started living in her matrimonial home the petitioner and other accused persons started committing cruelty and they further started demanding one golden chain weighing one bhar as additional dowry and on account of non-fulfillment of the same she was subjected to cruelty and assault by the accused petitioner and others in various ways on various occasions and ultimately she was ousted from her matrimonial home. Her husband also solemnized another marriage.

No.20656 of 2015 (2) dt.25-06-2015 2/2 It has been submitted on behalf of the petitioner that he is the husband of complainant and is ready to keep the complainant with full dignity but the same is not acceptable to the complainant. It has further been submitted that the petitioner has got no criminal antecedent. The petitioner states that he is ready to deposit a sum of Rs. 2000/- each month in the court below which may be released in favour of the complainant. On behalf of the State it has been submitted that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances, the petitioner is directed to deposit the amount of Rs.

2000/- each month in the court below and the same shall be released in favour of the complainant and then, in the event of his arrest or surrender in the court below within a period of four weeks, he shall released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Reshma Verma, Judicial Magistrate 1st class, Nalanda at Biharsharif in connection with complaint case No. 982 C/ 2014, subject to condition as laid down under section 438(2) of the Cr. P.C.
