2. The petitioner seeks bail in connection with S. Kamal P.S. Case No. 187 of 2025 dated 04.06.2025, registered for the offence under Sections 126(2), 115(2), 352, 351(1), 351(2), 109(1), 3(5) of the Bhartiya Nayay Sanhita.

3. It is alleged that all the FIR named accused persons including the petitioner assaulted the informant, upon protest being made, on the exhortation of the petitioner, namely, Shambhu Kumar, one co-accused Alok Kumar Gupta shot him by pistol which hit in his chest.

4. Learned counsel appearing for the petitioner submits that as regards the allegation of order giver is concerned, the same appears to be a super addition so as to

No.14769 of 2026(2) dt.12-03-2026 2/2 assign an overt act against him and the allegation of firing by the petitioner also appears to be a super addition as no empty cartridges were recovered from the place of occurrence. It has been further submitted that the accusation of firing upon the informant is against co-accused Alok Kumar Gupta and the petitioner has nothing to do with the offence. He further submits that the petitioner has no criminal antecedents and he is in custody since 08.12.2025.

5. Learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case and the fact that the accusation of firing upon the informant is against co-accused Alok Kumar Gupta, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif, Nalanda, in connection with S.Kamal P.S. Case No. 187 of 2025.
