The petitioner is apprehending his arrest in connection with Digha P.S.Case no.138 of 2017 , registered for offences punishable under Sections 376 of the Indian Penal Code. Earlier the prayer for bail of the petitioner was rejected vide order dated 8.9.2017 passed in Cr. Misc. No.41495 of 2017 with direction to the learned trial court to expedite the trial. Submission of the learned counsel for the petitioner is that the victim lady has been examined and she has not supported the prosecution case in her evidence.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above

Patna High Court Cr.Misc. No.24571 of 2018 (2) dt.25-04-2018 2/2 named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. IX, Patna in connection with Digha P.S.Case No.138 of 2017 pending before as Sessions Trial 628 of 2017, with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
