JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-09-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Sadar Khagaria P.S. Case No. 638 of 2019, registered under Sections 302, 201/34 of the Indian Penal Code.

The accusation is that in routine manner Sudama Sahni, son of informant Suresh Sahni moved from house in the morning of 15.08.2019 for fishing at Gandak river situated in west of Sirdhi Ghat, but, when he did not return in the noon to take lunch, the informant started searching his son and when he reached at Sirdhi Ghat then his son was found on a boat bearing Ganji and underwear and he was covered with plastic. Thereafter, he along with others carried his son Sudama at hospital, where doctor declared him dead. The informant,

No.13240 of 2020(4) dt.02-09-2020 2/2 further, alleged that before ten days dispute was occurred in respect to net of fishing in between his son Sudama with Shikendar Sahni (petitioner), Kudbudiya Sahni and Shambhu Sahni and he raised suspicion against them having hand in the murder of his son Sudama.

Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case mere on suspicion. Further submission is that in course of investigation, none witnesses have claimed to see the occurrence. Further submission is that petitioner has no criminal antecedent and he is in custody since 18.11.2019 without any fault.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Sadar Khagaria P.S.
