The petitioner seeks regular bail in connection with Akorhi Gola P.S.Case No.138 of 2017 registered for offences punishable under Sections 30(a)/34 of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of 05 ltrs. of liquor.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case. The petitioner is an accused in a criminal case. He has remained in custody 11.8.2017.

Having heard both sides and in view of allegation, this application is disposed of with direction that once the charge is

Patna High Court Cr.Misc. No.46219 of 2017 (2) dt.19-09-2017 framed or he completes three months more period in judicial custody, whichever is earlier, the learned court below shall release the petitioner in connection with Akorhi Gola P.S.Case No.138 of 2017 dated 11.8.2017.

With the aforesaid observation, this application is disposed of.
