The petitioner seeks bail in Runnisaidpur P.S. Case No.130 of 2017 registered under Sections 341, 323, 324 and 307 of the Indian Penal Code.
As per the prosecution case, the petitioner is said to have assaulted the informant, his wife and brother-in-law by means of katta, a sharp edged weapon.
It is submitted by learned counsel for the petitioner that the petitioner happens to be own brother of the informant. There is a property dispute between the parties. Petitioner is said to have assaulted the victims by a sharp cutting weapon but the doctor has found the injuries on the person of the victim Amit Kumar, one of which grievous inflicted by hard and blunt substance, which goes to rule out the case of the prosecution. The
Patna High Court Cr.Misc. No.50437 of 2017 (02) dt.18-10-2017 2/ 2 petitioner has been languishing in custody since 24.03.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No.130 of 2017.
