JUSTICE ARUN KUMAR ORAL ORDER 27-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 3.2.2018, seeks bail in Mashrak PS Case No. 21 of 2018 registered under Sections 413, 414 and 34 of the IPC.

The allegation in brief is that on the confessional statement of co-accused that he used to sell the looted vehicles, tractor and motorcycle, to the petitioner, leading to that confessional statement the police recovered five stolen motorcycles from the back of petitioner's house kept in a hut.

Learned Counsel for the petitioner submits that there is no allegation of committing theft by the petitioner, recovery is not from his house rather from the back of his house from a hut, the hut is not of the petitioner and he has clean antecedent. Having considered the said facts and circumstances, the petitioner, namely, Mangal Kumar Sah is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VI, Saran at Chapra in connection with Mashrak PS Case No. 21 of 2018 with the following conditions:-

Patna High Court Cr.Misc. No.25687 of 2018 (2) dt.27-04-2018 (i) one of the bailors shall be a close family member of the petitioner; and (ii) The petitioner is directed to appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
