====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2020 Heard learned counsel appearing for the petitioner as well as learned counsel appearing for the State through video conferencing.
Petitioner seeks bail in connection with Isuapur P.S. Case No. 258 of 2019 registered for the offences punishable under Sections 420, 467, 468, 471, 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act. Admittedly, neither petitioner was caught on the spot nor anything was recovered from his conscious possession and having more or less similar allegation, some co-accused have already been granted privilege of bail by different Benches of this Court whereas petitioner is languishing in jail custody for near about five months.

No.13373 of 2020(4) dt.20-05-2020 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge, Excise, Saran at Chapra in connection with Isuapur P.S. Case No. 258 of 2019.
However, it is made clear that if the petitioner fails to make available sureties due to lockdown as well as due to prevailing situation, the concerned court shall release the petitioner provisionally on personal bond with condition that petitioner shall furnish the sureties when lockdown is over.
