The petitioners seek bail in connection with Marhowrah (Marhaura) (Gaura O.P.) P.S. Case No.62 of 2020 registered under Sections 30 and 30(A) of the Bihar Excise and Prohibition Act, 2016.

The accusation is that in course of patrolling duty, when the informant along with other police personnel reached at the dam of Narharpur river, then four persons, on seeing the police party, tried to flee away but, on chase, two persons were apprehended, while two other persons succeeded to flee away, taking the advantage of the darkness. Patna High Court CR. MISC. No.13826 of 2020(2) dt.03-03-2020 2/2 disclosed their name as Jaleshwar Raut alias Bhuar (petitioner no.1) and Mantu Kumar (petitioner no.2). On their disclosure, 60 liters country made liquor and other apparatus meant for manufacturing the country made liquor were recovered. Both the petitioners disclosed the name of the persons, who succeeded to flee away, as Lagan Raut and Visheshwar Manjhi. Learned counsel appearing on behalf of the petitioners submits that the petitioners have no criminal antecedents and, on mere suspicion, they have falsely been implicated in this case. The petitioners are in custody since 03.02.2020. Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.

10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cumSpecial Judge, Excise, Saran at Chapra, in connection with Marhowrah (Marhura) (Gaura O.P.) P.S. Case No.62 of 2020. (Rajendra Kumar Mishra, J) P.S.
