Heard the parties.

The petitioners apprehend their arrest in connection with Makhdumpur (Tehta) P.S. Case No. 448 of 2021 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Petitioners are owners of the commercial vehicle i.e. bus. The owners of the vehicle cannot be saddled with responsibility for recovery of illicit liquor which was being transported by someone. The petitioners have no criminal

Considering the aforesaid facts, this application for anticipatory bail is allowed.

Accordingly, let petitioners, above-named, in the event of their arrest or surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.1, Jehanabad in connection with Makhdumpur (Tehta) P.S. Case No. 448 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
