1. Heard learned counsel for the petitioner, learned APP for the State and the learned counsel appearing on behalf of the complainant, Mr. Vijendra Kumar.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 406, 323 and 504 of the IPC in connection with Complaint Case No.01 of 2021.
3. The learned counsel appearing on behalf of the complainant, Mr. Vijendra Kumar submits that in the Court room he has received an amount of Rupees Forty Five Thousand Five Hundred in cash from the learned counsel appearing on
Patna High Court CR. MISC. No.17800 of 2024(5) dt.02-09-2024 2/3 behalf of the petitioner and the amount shall be handed over to the O.P. No.2.
4. It is further submitted that after receiving the amount an instruction was sought from the O.P. No.2, thereafter submits that he has instruction not to oppose the anticipatory bail application of the petitioner. It is further submitted based on instruction that O.P. No.2 shall withdraw the instant complaint case filed against the petitioner as his grievance stands redressed.
5. The learned counsel appearing on behalf of the O.P. No.2 further submits that he will handover the amount of Rs.45,500/- to the O.P. No.2.
6. The learned APP opposes the anticipatory bail application.
7. Considering the submissions made by the learned counsel appearing on behalf of the O.P. No.2, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Patna City, Patna in connection with
Patna High Court CR. MISC. No.17800 of 2024(5) dt.02-09-2024 3/3 Complaint Case No.01 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
8. The Court expects that the O.P. No.2 shall now withdraw the complaint case filed against the petitioner in the event, if the undertaking given to this Court is breached by the O.P. No.2, the learned counsel appearing on behalf of the petitioner shall be at liberty to bring the said fact to the notice of this Court.
9. The application stands allowed.
