JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-04-2015 Heard learned counsels for the petitioner and the State. The petitioner being the parent of the husband of the victim apprehending arrest in a case registered for the offences punishable under Section 304B/34 of the Indian Penal Code. The basic accusation is of killing the daughter of the informant for non-fulfillment of dowry demand. It is submitted by learned counsel for the petitioner that the accusation is not specific against the petitioner as the daughter of the informant committed suicide, moreover, the informant has retracted from initial allegation and has filed a petition to that effect before the learned court below. It is further submitted that husband of the victim was chargesheeted and put on trial where the informant has been examined as AW-1 but did not support the prosecution version.

No.11238 of 2015 (2) dt.28-04-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Ramgarh (Nuaon) P.S. Case No.66 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C., subject to condition to remain physically present before the court below on each and every date till conclusion of the trial and in case of default on three consecutive dates without giving any reasonable explanation, learned trial Court will be at liberty to cancel the bail bonds.
