The petitioners seek pre-arrest bail in connection with Forbesganj (Simraha) P.S. Case No. 887 of 2017 registered for the offences punishable under sections 341, 323, 307, 504/34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioners that on account of land dispute, a simple quarrel between the parties had taken place and though the informant had sustained only simple and superficial injury, a case under Section 307 of the Indian Penal Code has been registered.
Patna High Court Cr.Misc. No.26429 of 2018 (2) dt.04-05-2018 2/2 Learned counsel for the State has opposed the application for grant of pre-arrest bail.
Considering the nature of allegations made in the F.I.R. and the submissions made above, in the event of arrest or surrender before the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj (Simraha) P.S. Case No. 887 of 2017 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
