The petitioner apprehends his arrest in a case under Sections 419 and 420 of the Indian Penal Code. Allegation against the petitioner is that in place of the petitioner, one Rakesh Kumar was appearing at the examination having Roll No. 0600 and Roll Code 74012.

Considering the fact that it was the petitioner, who set up Rakesh Kumar to appear at the examination in his place for getting good marks, I am not inclined to enlarge the petitioner on anticipatory bail in Dehri (Town) P.S. Case No. 149/2013. Accordingly, the same is rejected.

The petitioner is directed to surrender in the court below within four weeks from today and make prayer for regular bail. The court below shall consider the prayer for regular bail of

Patna High Court Cr.Misc. No.16062 of 2015 (2) dt.28-04-2015 2/2 the petitioner on the same day without being prejudiced by this order.
