JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-05-2019 This application, for grant of anticipatory bail, arises out of Alamganj P.S. Case No. 702 of 2019, disclosing offences under Sections 409, 420 and 34 of the Indian Penal Code. Allegation is that the petitioner was appointed on adhoc basis on the post of lecturer till 31.12.1984 but in spite of that he got his services regularized in the light of Bihar Ordinance No. 32 if 1986 after concealing the facts and after keeping the department in dark.

Submission of learned counsel for the petitioner is that the petitioner was regularized as per the provisions contained in Ordinance (Annexure-5), however, on wrong interpretation order has been passed and the case has been lodged.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City, in connection with Alamganj P.S. Case No. 702 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
