2. The matter has been listed upon a motion slip being filed by the petitioner's counsel.

3. Heard the parties.

4. Learned counsel for the petitioner submits that the petitioner would be filing representation in respect of the relief claimed in the instant writ proceedings for transfer. He has been posted as Ayush Doctor and that the brochure allowed the petitioner to give three options for places of posting, which has not been considered.

5. Mr. K.K.Sinha, appearing for the State Health

Patna High Court CWJC No.4967 of 2020(2) dt.08-07-2022 2/2 Society submits that the brochure does not vest any right in favour of the petitioner which is obvious from bare perusal of the same. He, however, does not dispute that in case of deserving circumstances, the Society has considered requests, subject to availability of vacant post at the requested place of posting and other administrative exigencies.

6. In view thereof, Mr. Sinha, learned counsel for the petitioner, submits that he would be filing his representation before the Executive Director, State Health Society, Bihar (Respondent No.3). Without expressing any opinion on the merits of the petitioner's claim, the application is disposed of with liberty to avail the remedy as prayed for. (Madhuresh Prasad, J) shyambihari/- U
