2. The petitioner seeks regular bail in a case registered for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner along with other co-accused persons is said to have killed the deceased. Petitioner is in jail since 22.12.2023.

4. In the trial of other co-accused persons, all the witnesses have become hostile and the accused persons have been acquitted. The statement of the son of the informant who is the alleged eye-witness in the connected trial also helps the petitioner.

5. No useful purpose will be served by keeping the petitioner in custody.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail after framing of charge if the charge has not already been framed and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Saran at Chapra/concerned Court below in connection with Marhaura P.S. Case No. 742 of 2020.

8. This application stands allowed.
