19-09-2017 Heard Sri Dhananjay Kumar Shahi, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 13-07-2017 in Siwan Town P.S. Case No. 374 of 2017 registered for offence under Section 30, 36, 41 of Bihar Prohibition and Excise Act, 2016 and Sections 420/34 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that from one Scorpio vehicle, recovery of total 3 liters of 500 ml. each of cane containing beer was recovered and since petitioner was found near the vehicle, he was arrested, as if, petitioner was having connection with the beer. He submits that

Patna High Court Cr.Misc. No.43039 of 2017(2) dt.19-09-2017 2/2 driver of the vehicle had already fled away.

Considering the nature of accusation and period of custody, let the petitioner namely Ramendra Kishore @ Mintu Rai be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II cum Special Judge, Excise, Siwan in connection with Siwan Town P.S. Case No. 374 of 2017.
