Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act. A loaded country made pistol was allegedly recovered from possession of the petitioner. Petitioner is in custody since 24.10.2017. Investigation of the case is already complete against the petitioner. Petitioner has got criminal antecedent.

Submission is that co-accused Nikku Lala @ Nikku Sinha has already been allowed bail by a Coordinate Bench of this Court vide order dated 15.03.2018 passed in Cr. Misc. No. 14960 of 2018. Allegation against Nikku Lala is similar to that of

Patna High Court Cr.Misc. No.24333 of 2018 (2) dt.26-04-2018 2/2 the petitioner.

Considering the facts of this case aforesaid, let the petitioner, above named, be released on bail on completion of one year of custody on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Laxmipur Police Station Case No. 245 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
