The petitioner is apprehending his arrest in a case registered under Sections 147, 148, 149, 341, 323, 325, 307, 427, 379, 504 and 506 of the Indian Penal Code. The prosecution case, in short, is that the accused persons indiscriminately assaulted the informant and his father. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is a case and counter case between the parties. A free fight is alleged to have taken place. The police

Patna High Court CR. MISC. No.15206 of 2019(2) dt.12-03-2019 2/2 after investigation submitted final form against the petitioner in which the petitioner was not sent up for trial. The Court below differed with the police report and taken cognizance. General and omnibus allegation of assault has been made against 39 persons.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Ravi Ranjan, Judicial Magistrate, 1st Class, Begusarai in connection with Begusarai Town P.S. Case No. 613/2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
