The present writ petition has been filed by the petitioner for following reliefs:- (i) For issuance of writ in the nature of certiorari for quashing of the order dated 30-082024 passed by the Land Reforms Deputy Collector, Bihar Sharif in Measurement Appeal Case No. 14/2023-24 whereby the appeal preferred by the petitioner against the order dated 09-022024 passed by the Circle Officer, Bihar Sharif in Measurement Case No. 66/2023-24 has been
Patna High Court CWJC No.4480 of 2025(2) dt.24-03-2025 2/3 rejected on the ground of pendency of Title Suit No. 118/2006.
(ii) For issuance of writ in the nature of certiorari for quashing of the order dated 09-022024 passed by the Circle Officer, Bihar Sharif in Measurement Case No. 66/2023-24 whereby the application submitted by the petitioner for measurement of 67.0069 decimals of land in Thana No. 110, Khata No. 248, Khesra No. 1438, MauzaRampur Baignabad, Circle Office Bihar Sharif, has been rejected taking the plea of the situation of law and order.
(iii) For necessary direction upon the respondent authorities to conduct the measurement and demarcation of 67.0069 decimals of land in Thana No. 110, Khata No. 248, Khesra No. 1438, Mauza-Rampur Baignabad, Circle Office Bihar Sharif as per the prayer made by the petitioner in presence of the Police force and the Magistrate. (iv) For any other direction which your Lordships may deem fit and proper in the facts and circumstances of the case.
3. The petitioner may take the alternative remedy provided for redressal of his grievance under Section 9 of the Bihar Land Tribunal Act, 2009.
4. If the petitioner files his petition before the Bihar Land Tribunal within a period of six weeks from today, the same shall be disposed of as expeditiously as possible, preferably within a period of six months.
5. It is hereby made clear that the point of limitation shall not come in the way of disposal of the petition filed by the
Patna High Court CWJC No.4480 of 2025(2) dt.24-03-2025 3/3 petitioner.
6. With these observations, the writ petition stands disposed of.
