1. Learned counsel for the respondent submits that the petitioners compassionate appointment application cannot be considered for the post of teacher, as the petitioner is not a trained graduate. His application form was returned with permission to apply for other posts, but there is no application moved by him. The learned counsel for the respondent states that if he applies for other posts his case shall be immediately considered and appointment shall be offered to him.

2. Keeping in view the candid stand taken by the respondent counsel, learned counsel appearing for the petitioner

Patna High Court CWJC No.5053 of 2020(2) dt.25-11-2022 2/2 submits that he may be appointed on a equivalent post. Considering the above, it is directed that if the petitioner applies afresh for compassionate appointment, the respondent State shall consider his candidature for appointment on any other post, apart from that of teacher. If he is found to be in the same category, that is application is for compassionate grounds, he shall be offered appointment within period of three months from the date of submission of application.
