The petitioner is apprehending his arrest in connection with Fatehpur P.S. Case No. 07/2015 for the offences instituted under Sections 304(B) and 201/34 of the IPC.

The prosecution story, in brief, is that the petitioner is the husband who is alleged to have tortured the informant's sister with the help of other family members and thereafter committed murder for non-fulfilment of demand of dowry and disposed of the dead body to screen the evidence of crime.

It has been submitted by learned counsels for the petitioner and the petitioner has got no criminal antecedent. It is

Patna High Court Cr.Misc. No.21775 of 2015 (3) dt.04-09-2015 2/2 further submitted the deceased had died due to illness and for which treatment was also provided to her. This fact has come in course of investigation also.

On behalf of the State it has been submitted that the petitioner is the husband of the deceased.

Considering the aforesaid facts and circumstance, I am not inclined to grant anticipatory bail to the petitioner in connection with Fatehpur P.S. Case No. 07/2015, pending in the court of the learned C.J.M., Gaya. The same is rejected. Anyhow, if the petitioner surrenders in the court below within a period of six weeks from the date of receipt/production of copy of this order the same shall be considered on its own merit without being prejudiced by this order preferably on the same day.
