The petitioners apprehend their arrest in Sirdala P.S. Case No. 173/2015, registered for the offence punishable under Sections 307 and other sections of the Indian Penal Code. The informant alleged that while he along with his family members were weeding grass in paddy field petitioners came and brutally assaulted him, his father and mother. It is submitted that counter version bearing Sirdala P.S. Case no. 174/2015 was filed by Sudama Devi wife of Mahendra Prasad due to land dispute.
It is submitted that Santosh Prasad and his mother got
Patna High Court Cr.Misc. No.16326 of 2016 (3) dt.01-07-2016 2/2 simple injuries. Rajendra Prasad father of Santosh Prasad got one grievous injury, but no specific allegation of assault is made. Considering the facts aforesaid and the fact that there were quarreling between both the parties and there is land dispute, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in connection with Sirdala P.S. Case No. 173/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
